Will and Probate of Abel Brown
Will Book G, p. 222 #1619, Belmont County, Ohio

J Abel Brown of York Township, Belmont County and State of Ohio do make and publish this my list will and testiment hereby revoking and making void all former wills by me made: and first I direct that my body be ___ intered in the burying ground that I shall direct according to the rites and ceremoneys of the church to which I belong and that my Funeral be conducted in a manner corresponding with my state and situation in life:  and to such worldly extate as it hath pleased God to bless me with.  I disspose of the same as followeth:  First I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my executors from any portion of my extate real or personal:  Also I direct that a fair evaluation or appraisment be made, by three judiuious neighbours of all my said extate including my household furnature, and after being signed with their names, that a copy of the same shall be given by them to each of my executors:  and to effective this my intention.   I do hereby ____ in my executors full power and authority to despose of my real extate in fee simple or for a term of years or other wise in as full a maner in every respect as I could my self do, if living:  Also I direct that my beloved wife, if she shall be living at the time of my demise gets all my property real and personal her lifetime and at her death, then Joseph Brown is to get fifty dollars, John & Isaac Brown one hundred each:  as soon after her death as my extate can be put to sale and the money collected.  Also I direct that after the fore named sums are taken out the balance of all moneys ____ from the sales of all my extate, shall be divided equally amongst all my children share and share alike.  The heirs or representatives of any of my children, who shall have died between the time of my decease and the time of such division or distribution to be entitled to such share as where _____ ____ would have been entitled to receive if then living:  and the whole of my real and personal estate thus bequethed to my wife to be in liue of her dower at common law if she shall so elect.   And I do hereby make and ordain my exteemed brother John Brown and my son Joseph Brown executors of this my last will and testiment:  In witness whereof I Able Brown the testator, have to this my will written on one sheet of paper set my hand and seal this seventeenth day of July eighteen hundred and thirty one. The State of Ohio Belmont County
Court of Common Pleas                                 April term A.D. 1841

Robert B. Green and George W. Green, the subscribing witnesses to the will of Abel Brown late of said County deceased, came into court and being solemily sworn, in open court, each for himself on his oath saith, that he saw the testator sign said will, that he subscribed the same as a witness thereto in the presence of the testator and this request; that the testator at the time of the signing said will was of sound mind & memory, seventy one years of age and under no restraint.
